Last week, senators in the state of Michigan introduced a piece of legislation that would legalize the possession, growing and delivery of various fungi- and plant-derived psychedelics, including mescaline and psilocybin.
The bill, which was sponsored by Senators Adam Hollier and Jeff Arwin, would alter state statutes to exempt individuals from criminal penalties for such activities, as long as they weren’t receiving valuable consideration, cash as money for the entheogenic fungi and/or plants. This is because commercial sales and production of the psychedelics wouldn’t be legal under the initiative.
However, the measure does clarify that individuals would be allowed to charge some fee for spiritual guidance, counseling or an associated service that’s offered in conjunction with the use of entheogenic fungi or plants, under the supervision and guidance of a person offering the service.
Irwin stated that entheogenic substances had religious significance and possessed medicinal value, adding that they weren’t prone to abuse, which made them relatively safe. The entheogenic fungi and plants covered under the measure include fungi and plants that can naturally produce psilocin, psilocybin, mescaline, ibogaine and DMT.
The state has become a hub for psychedelics movements, with some chapters of the Decriminalize Nature group in the state calling for their city councils to enact reforms. Last year, the city council of Ann Arbor approved entheogenic decriminalization. Local legislators recently approved a resolution to make September the Entheogenic Plants and Fungi Awareness Month. The Grand Rapids city council is also working on approving a policy change for psychedelics.
In California, Sen. Scott Wiener has advanced a measure through the Senate to legalize the possession of psychedelics. Activists in the state are also hoping to place a measure before voters in 2022, whose approval would legalize the sale and possession of psilocybin.
Last year, voters in the state of Oregon approved a measure to legalize psilocybin for therapeutic use. This is in addition to also passing a measure to decriminalize the possession of all drugs.
The cities of Cambridge, Somerville and Northampton, in the state of Massachusetts, have also enacted policy changes. In the state of Texas, a legislation that would mandate the state to conduct research on the medical benefits of psychedelic substances for military veterans was recently introduced. A legislator from the state of New York also introduced a similar legislation in June that would direct the state to set up an institute to study the medical value of psychedelic substances.
