Activists in Oakland Launch Plan to Legalize Sales of Psychedelic Substances

Activists in Oakland are hoping to establish a community-based model through which individuals could legally buy entheogenic substances from local producers. This will expand Oakland’s present psychedelics decriminalization law.

The California city became the first city in the United States to decriminalize a wide range of psychedelic substances, including ayahuasca and psilocybin, in 2019.

Decriminalize Nature and other activist groups have been behind various local psychedelic reform efforts across the country, enacting decriminalization measures in states such as Washington, Michigan, Massachusetts and California.

Thus far, local legislators have approved a second measure that builds upon the initial Oakland decriminalization of the cultivation and personal use of entheogenic fungi and plants. This second measure, which was approved in 2020, urges lawmakers in California to permit local jurisdictions to allow healing ceremonies where individuals can use entheogenic plants and fungi.

Advocates are now calling for the city of Oakland to make the move on its own. The process to draft the measure is being sponsored by Councilmember Noel Gallo. It will start with acquiring input from advocates and stakeholders from various parts of the country and holding a series of public workshops. The advocates’ objective is to present the initiative to the Oakland city council in summer 2022.

The chair of Decriminalize Nature, Carlos Plazola, stated in a press release that various indigenous groups have used plant medicines successfully and safely for millennia, despite efforts to extinguish and oppress their use. He further noted that it made sense that the benefits of entheogens be enjoyed not only by indigenous people but also communities of color and local communities generally.

Apart from Oakland, local officials in the cities of Arcata and Santa Cruz have decriminalized an extensive range of psychedelic substances.

A separate measure to legalize psychedelic substances in the state of California has also been advanced through a pair of Assembly committees and the Senate before it was pulled by its sponsor, Senator Scott Wiener.

Psychedelics reform is also being pursued by other activists and legislators in other parts of the country. For instance, the city council of Seattle recently passed a measure to decriminalize noncommercial activity around an extensive range of psychedelics, including the sharing and growing of nonpeyote-derived mescaline, ibogaine, ayahuasca and psilocybin mushrooms.

Two senators in Michigan also introduced a measure last month to legalize the growing, possession and delivery of various fungus-and-plant-derived psychedelics, including mescaline and psilocybin.
