Cannabis reform advocates in South Dakota are fighting a battle that could ultimately determine the state’s ballot initiative process. On Nov. 3, 2021, South Dakotans voted to pass Amendment A and Measure 26, legislation that would have legalized the recreational and medical use of cannabis respectively, making South Dakota the first state to pass both medical and recreational cannabis measures at the same time. Legislators in Vermont have introduced legislation that would put an end to criminal penalties on small amounts of illegal drugs. The bill, which was introduced last week, states that the dispensation and possession of small drug amounts would be subject to a referral to a substance-use health and screening service or a fine of up to $50 dollars. The legislation, dubbed H. 422, is sponsored by Reps. Logan Nicoll, Selene Colburn and 12 other legislators. Supporters state that the measure offers a public health approach to overdose deaths and drug use disorders.

Beginning on March 1, 2021, applicants for five types of recreational cannabis licenses will not be required to have an active medical marijuana license to qualify.
